Recruiter Platform — Terms of Service

This agreement governs access to hire.resumelyn.com ("the Platform"), operated by Resumelyn ("we," "us," "our"), an independent developer based in the Netherlands. By purchasing a license and accessing the Platform, the subscribing company or individual ("Recruiter," "you") agrees to these Terms in full.
1. Nature of the Service
The Platform provides licensed access to a searchable database of candidate profiles who have explicitly opted into Resumelyn's Exclusive Talent Pool. Features include profile search, CV downloads, candidate filtering, and recruiter analytics tools. Access is granted per the license tier purchased.
2. License Tiers and Access
Access to the Platform is provided under a paid license. Available tiers and pricing are published at hire.resumelyn.com/pricing. All licenses are:
- Non-transferable between accounts or organizations.
- Limited to the number of seats specified at the time of purchase.
- Valid for the duration stated at checkout (monthly, annual, or one-time, depending on the tier).
Resumelyn reserves the right to modify pricing and tier features with 30 days' advance notice to active subscribers.
3. Candidate Data and Joint Controller Obligations
This is the most critical section of this agreement. By accessing candidate profiles and downloading CV files, you agree to the following:
3.1 Joint Controller Status
Under GDPR Art. 26, Resumelyn and the Recruiter act as joint controllers for any personal data accessed through the Platform. Each party is independently responsible for compliance with GDPR in relation to their respective processing activities.
3.2 Permitted Use of Candidate Data
You may use candidate data exclusively for the purpose of evaluating and contacting candidates for legitimate employment opportunities. Specifically, you agree NOT to:
- Share, sell, sublicense, or transfer candidate data to any third party not directly involved in the hiring process.
- Use candidate data for marketing, advertising, or any purpose unrelated to recruitment.
- Store candidate CVs or personal data beyond the period necessary for the specific hiring process.
- Re-upload or redistribute candidate data to other platforms, databases, or ATS systems without the candidate's explicit consent.
3.3 Data Retention by Recruiter
You are required to delete any downloaded candidate data within 90 days of the conclusion of the relevant hiring process, unless the candidate has provided separate written consent for longer retention. Upon request from Resumelyn or from the candidate directly, you must confirm deletion within 14 days.
3.4 Security
You are responsible for implementing appropriate technical and organizational measures to protect candidate data from unauthorized access, loss, or disclosure while in your possession.
4. Candidate Consent and Opt-In
All candidates visible on the Platform have explicitly opted into Resumelyn's Exclusive Talent Pool via a clear, documented opt-in mechanism compliant with GDPR Art. 6(1)(a). Resumelyn maintains records of this consent. However, candidates may withdraw their consent at any time, at which point their profile will be removed from the Platform. Resumelyn will notify active Recruiters of material removals that may affect ongoing hiring processes.
5. Prohibited Conduct
As a licensed Recruiter, you agree not to:
- Scrape, crawl, or automate data extraction from the Platform by any means.
- Attempt to reverse-engineer, copy, or replicate the Platform's database or matching logic.
- Create fake recruiter accounts or misrepresent your organization's identity.
- Contact candidates in a harassing, discriminatory, or unlawful manner.
- Use the Platform for any purpose that violates applicable employment or data protection law.
Violations may result in immediate account suspension and legal action.
6. Disclaimers
Resumelyn does not guarantee the accuracy, completeness, or fitness-for-purpose of any candidate profile or CV. Candidate information is self-reported and AI-processed. Hiring decisions are the sole responsibility of the Recruiter. Resumelyn is not a party to any employment relationship established through the Platform.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Resumelyn's total aggregate liability for any claim arising from these Terms shall not exceed the total amount paid by the Recruiter in the 12 months preceding the event giving rise to the claim. Resumelyn shall not be liable for indirect, incidental, or consequential damages, including loss of business, failed hires, or data breaches caused by the Recruiter's own systems.
8. Indemnification
You agree to indemnify and hold harmless Resumelyn from any claims, penalties, fines, or legal expenses arising from: (a) your misuse of candidate data; (b) your violation of GDPR or applicable employment law; (c) your breach of these Terms.
9. Termination
Either party may terminate access with 30 days' written notice. Resumelyn may terminate immediately for material breach of Section 3, 4, or 5. Upon termination, you must delete all downloaded candidate data within 14 days and confirm deletion in writing upon request.
10. Governing Law
These Terms are governed by the laws of the Netherlands. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, Netherlands.
